This presentation is an overview of how incapacity planning (or a lack thereof) intersects with charitable giving. Real life and hypothetical scenarios will be provided for collaborative discussion.

Building on this foundation, the session will explore the practical, ethical, and legal considerations that arise when a donor’s capacity changes over time. Attendees will gain insight into how diminished capacity can impact charitable intent, gift execution, and relationships with advisors, family members, and nonprofit organizations.

Through guided discussion and case-based examples, participants will examine common challenges—such as unclear documentation, conflicting stakeholder interests, and evolving donor wishes—and identify strategies to navigate these situations with clarity and integrity. The session will also highlight best practices for proactive planning, including the role of documentation, communication, and advisor collaboration in preserving donor intent.

Ideal for philanthropic advisors, nonprofit professionals, and allied experts, this program will equip attendees with practical frameworks and considerations to better support donors and their charitable goals when capacity changes occur.
